Terms of Service

The rules for using S.C.A.L.E., in plain English. The key points: scan sites you have a reason to scan, the scores are guidance rather than a guarantee, and your data stays yours.

Agreement

These terms govern your use of S.C.A.L.E. at scale.siamakconsulting.com (the “Service”), operated by Siamak Kalhor, doing business as Siamak Kalhor Consulting (“we”, “us”). By using the Service you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.

You must be at least 18 and, if you use the Service for a business, have authority to accept these terms for it.

What the Service is

S.C.A.L.E. reads a public web page, runs it through a fixed set of named checks, and gives you scores across five dimensions and a ranked list of suggested fixes. A free account keeps your history so later scans can show change.

The Service is new and still evolving. We may add, change or remove features, and we may limit or pause access when needed, for example to prevent abuse.

Your account

Acceptable use

Scan websites you own or manage, or public pages you have a legitimate reason to evaluate, such as a competitor's homepage for comparison. Don't:

What the scores are, and aren't

Scores are an informational assessment of public signals on a web page. They are not a guarantee of search rankings, of being mentioned or recommended by any AI system, or of any business result.

AI assistants and search engines are run by other companies, use signals we can't see, and change without notice. Suggested fixes are general guidance, not legal, financial or other professional advice, and you decide whether and how to act on them.

Your data and our rights

You own the information you enter and the results about your business. You give us permission to store and process it only as needed to run and improve the Service, as described in the Privacy Policy.

The S.C.A.L.E. name, the S.C.A.L.E. Framework, the checks and scoring method, and the software belong to Siamak Kalhor Consulting. You may share your own results freely; please don't present the Service or its methodology as your own.

Plans, billing and cancellation

S.C.A.L.E. has a free plan and two paid plans, Growth ($29 a month) and Scale ($99 a month), as described on the pricing section. Prices are in US dollars and exclude any taxes that apply.

Consulting services bought from siamakconsulting.com, such as a strategy session or the AI Authority Audit, are separate purchases covered by the terms on that site.

Ending your use

You can stop using the Service at any time and ask us to delete your account (see the Privacy Policy). We may suspend or end access for misuse or if we discontinue the Service; if we discontinue it, we'll give account holders reasonable notice and a way to export their history.

Disclaimer

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise the Service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or US $100.

Some jurisdictions don't allow some of these limits, so they may not all apply to you.

Indemnity

If you use the Service in breach of these terms or the law, and that leads to a claim against us, you agree to cover the reasonable costs of that claim.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts in Los Angeles County, California. Before filing a claim, you agree to contact us first so we can try to resolve it informally.

Changes and general terms

We may update these terms. We'll change the date at the top and, for significant changes, email account holders before they take effect. Continuing to use the Service after that means you accept the updated terms.

If any part of these terms can't be enforced, the rest still applies. Not enforcing a right isn't a waiver of it. These terms and the Privacy Policy are the whole agreement between us about the Service.
